Important Notice

This document contains the Terms and Conditions that govern the use of the E-MANDO platform. These terms apply to all users including clients, service providers, and anyone accessing the platform.

For specific service terms: Please refer to the User Agreement (for customers) or Workers Agreement (for service providers).

E-MANDO TERMS AND CONDITIONS

These Terms and Conditions contain important legal provisions including waivers of liability, assumption of risk, and limitations on your legal rights. By using the E-MANDO platform, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Acceptance of Terms

By accessing, registering for, downloading, or using the E-MANDO mobile application, website, platform, or any related services (collectively, the "Platform"), the user, client, or service provider ("User") expressly agrees to be legally bound by these Terms and Conditions. If the User does not agree, the User must immediately discontinue use of the Platform.

2. Nature of the Platform

E-MANDO operates solely as a technology-based intermediary and coordination platform that facilitates connections between users and independent third-party service providers, including manpower and emergency-related service coordination.

E-MANDO does not provide, perform, supervise, control, or guarantee any manpower, emergency, medical, rescue, police, fire, or security services.

3. Independent Contractors

All service providers registered or engaged through E-MANDO are independent contractors and not employees, agents, partners, or representatives of E-MANDO.

E-MANDO assumes no responsibility or liability for the acts, omissions, conduct, performance, qualifications, licenses, or decisions of any service provider or user.

4. Assumption of Risk

The User voluntarily and knowingly assumes all risks, whether known or unknown, foreseeable or unforeseeable, arising from or related to the use of the Platform, including but not limited to:

  • Personal injury, bodily harm, illness, or death
  • Property loss, theft, or damage
  • Delays, errors, or failure of response
  • Accidents, disputes, or negligence of third parties

All services are availed of entirely at the User's own risk.

5. Limitation of Liability

To the maximum extent permitted by applicable law, E-MANDO, including its owners, officers, directors, shareholders, employees, developers, and affiliates, shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

  • Personal injury or death
  • Loss of income, profit, data, or business
  • Property damage or loss
  • Service failure, delay, or interruption

This limitation applies regardless of cause, whether based on contract, tort, negligence, strict liability, or any other legal theory, even if E-MANDO has been advised of the possibility of such damages.

6. Emergency Services Disclaimer

E-MANDO does not guarantee availability, response time, effectiveness, accuracy, or outcome of any emergency-related coordination.

Important: E-MANDO is not a substitute for official emergency services. In life-threatening situations, Users are advised to contact government emergency hotlines directly.

7. Waiver and Release

The User hereby irrevocably waives, releases, and forever discharges E-MANDO from any and all claims, demands, liabilities, actions, or causes of action, whether civil, criminal, or administrative, arising out of or related to:

  • Use or inability to use the Platform
  • Services requested or rendered through E-MANDO
  • Acts or omissions of any third party

8. Indemnification

The User agrees to indemnify, defend, and hold harmless E-MANDO from and against any and all claims, damages, losses, costs, and expenses (including attorney's fees) arising from:

  • The User's misuse of the Platform
  • Violation of these Terms
  • Violation of any law or third-party rights

9. Force Majeure

E-MANDO shall not be held liable for any failure or delay caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, power or network outages, government actions, pandemics, or public emergencies.

10. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute shall be brought exclusively before the proper courts of competent jurisdiction.

11. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

User Acknowledgment

By using the E-MANDO platform, you acknowledge that:

  • You have read and understood these Terms and Conditions
  • You accept all risks associated with using the platform
  • You waive certain legal rights as specified above
  • You agree to the governing law and jurisdiction provisions
