1. Acceptance of Terms

By accessing, registering for, or using the E-MANDO Emergency Response System (ERS) ("Service"), you ("User," "Subscriber," or "You") agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

E-MANDO Emergency Response System (ERS) provides:

• Emergency Alert Coordination: Notification and coordination with nearby responders
• Response Coordination: Assistance in connecting with appropriate emergency services
• Location Sharing: Real-time location sharing with emergency contacts
• Information Relay: Relay of critical information to responders
• Status Monitoring: Emergency status tracking and updates

3. Subscription Service

• Completely Optional: Subscription is voluntary
• Manual Payment: No automatic billing - you must manually pay each month
• No Auto-renewal: Service does not automatically renew

• Non-refundable: Payments are non-refundable once made
• Basic Access: Basic emergency coordination remains free for all users

4. LGU Partnership Program

4.1 Memorandum of Agreement (MOA)

Local Government Units (LGUs) may access comprehensive ERS coverage through a formal Memorandum of Agreement (MOA) with E-MANDO.

4.2 LGU Service Package

4.3 LGU Responsibilities

• Enter into formal MOA with E-MANDO
• Provide accurate local emergency contact information
• Coordinate with local emergency services
• Maintain admin dashboard access credentials
• Comply with data protection regulations
• Ensure proper use of the ERS system
• Designate authorized personnel for system access

5. User Responsibilities

As an ERS user, you agree to:

• Use the service only for genuine emergency situations
• Provide accurate and current personal information
• Maintain up-to-date emergency contact information
• Not make false or prank emergency reports
• Contact official emergency services first in life-threatening situations
• Keep your account credentials secure
• Report any unauthorized use of your account immediately
• Comply with all applicable laws and regulations

6. Service Limitations and Disclaimers

• Immediate Response: We cannot guarantee immediate response in all situations
• Service Availability: Service may not be available in all geographic areas
• Network Connectivity: We rely on existing network infrastructure
• Response Effectiveness: We do not control or guarantee responder actions
• Outcome Guarantee: We cannot guarantee the outcome of any emergency situation
• 24/7 Availability: While we strive for constant availability, technical issues may occur
• Official Response: We are not official emergency services

7. Limitation of Liability

To the maximum extent permitted by law, E-MANDO, its owners, officers, directors, employees, and affiliates shall not be liable for:

• Personal injury, death, or property damage
• Failure or delay in emergency response
• Service interruptions or technical failures
• Acts or omissions of third-party responders
• Inaccurate or incomplete information provided by users
• Network or connectivity issues
• Consequences of false or prank emergency reports
• Any direct, indirect, incidental, or consequential damages

8. Prohibited Activities

You agree NOT to use the ERS for:

• False, prank, or non-emergency reports
• Impersonating any person or entity
• Testing the system without genuine need
• Harassing or threatening others
• Any illegal or unauthorized purpose
• Commercial exploitation of emergency services
• Circumventing any security measures
• Sharing inappropriate or harmful content
• Attempting to gain unauthorized access

9. Account Termination

E-MANDO may immediately terminate or suspend your access to the ERS without notice if:

• You violate these Terms of Service
• You make false emergency reports
• You misuse the emergency system
• Required by law or government authorities
• To protect the safety of other users
• For any abusive or harmful conduct

10. Intellectual Property

All ERS software, content, features, and functionality are owned by E-MANDO and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without explicit permission.

11. Privacy and Data Protection

Emergency situations may require sharing of personal information with responders. By using the ERS, you consent to necessary information sharing for emergency coordination. Please review our Privacy Policy for detailed information.

12. Changes to Terms

We may modify these Terms of Service at any time. We will notify users of significant changes through the service or via email. Continued use after changes constitutes acceptance of the modified terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
