Important Legal Notice for Customers

This User Agreement governs your use of the E-MANDO on-demand service platform. By using our services, you acknowledge that you understand and accept these terms, including limitations of liability and assumption of risk.

1. Agreement to Terms

As a Customer ("User," "Client," or "You"), by accessing, registering for, downloading, or using the E-MANDO mobile application, website, platform, or any related services (collectively, the "Platform"), you expressly agree to be legally bound by this User Agreement.

2. Nature of the Platform

E-MANDO operates as an on-demand service platform that connects you with independent third-party service providers for:

Emergency response coordination and assistance
Manpower services through registered providers
Real-time emergency monitoring and dispatch
Connection with police, medical, and fire emergency responders

Platform Disclaimer: E-MANDO is a technology-based intermediary and coordination platform only. We do not provide, perform, supervise, control, or guarantee any emergency, medical, rescue, police, fire, security, or manpower services.

3. Independent Contractors

All service providers available through E-MANDO are independent contractors and not employees, agents, or representatives of E-MANDO. As a customer, you understand that:

E-MANDO does not supervise or control service providers
You are responsible for verifying the qualifications of service providers
Any agreement for services is between you and the service provider
E-MANDO assumes no liability for acts or omissions of service providers
Service providers set their own rates and terms for services

4. Optional Premium Subscription

Optional Service: Premium features are available through an optional monthly subscription of ₱50. This subscription is NOT automatic and requires manual renewal each month.

Premium subscription terms:

Optional: Subscription is completely voluntary
Manual Payment: No automatic billing - you must manually pay ₱50 each month
No Auto-renewal: Service does not automatically renew
Cancel Anytime: You may stop subscribing at any time
No Refunds: Payments are non-refundable once made
Trial Period: 1-month free trial available for new users

Basic platform access and emergency coordination services remain available to all registered users regardless of subscription status.

5. Customer Responsibilities

As a customer of our on-demand platform, you agree to:

Provide accurate and complete information during registration
Use the service only for genuine emergency or service needs
Not make false or prank emergency reports
Maintain the security of your account credentials
Comply with all applicable laws and regulations
Not interfere with platform operations or other users
Verify service provider qualifications before engaging their services
Pay for services directly to service providers as agreed

6. Assumption of Risk

You voluntarily assume all risks associated with using the Platform and services obtained through it, including but not limited to:

Personal injury, bodily harm, illness, or death
Property loss, theft, or damage
Delays, errors, or failure of response
Accidents, disputes, or negligence of third parties
Service interruptions or technical failures

All services are requested and availed of entirely at your own risk.

7. Emergency Services Disclaimer

Critical Notice: E-MANDO is not a substitute for official emergency services. We do not guarantee availability, response time, or outcome of any emergency coordination. In life-threatening situations, immediately contact government emergency services directly.

E-MANDO provides coordination services only. We cannot guarantee:

Immediate response in all situations
Service availability in all geographic areas
Accuracy or effectiveness of third-party responders
Network connectivity at all times
Outcome of any emergency situation

8. Limitation of Liability

To the maximum extent permitted by applicable law, E-MANDO, including its owners, officers, directors, shareholders, employees, developers, and affiliates, shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

Personal injury or death
Loss of income, profit, data, or business
Property damage or loss
Service failure, delay, or interruption

This limitation applies regardless of cause, whether based on contract, tort, negligence, strict liability, or any other legal theory.

9. Service Payments and Transactions

For services obtained through the platform:

Payment terms are negotiated directly between you and the service provider
E-MANDO does not process payments for individual services (except optional premium subscriptions)
You are responsible for paying service providers according to your agreement with them
E-MANDO is not involved in payment disputes between users and service providers
The ₱50 monthly premium subscription is processed separately from service payments

10. Termination

E-MANDO may suspend or terminate your access to the Platform if you violate this agreement, engage in prohibited activities, or if we believe such action is necessary to protect other users or the platform.

11. Governing Law

This User Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Customer Acknowledgment

By using E-MANDO as a customer, you acknowledge that:

You have read and understood this User Agreement
E-MANDO is an on-demand coordination platform only, not a service provider
Service providers are independent contractors, not E-MANDO employees
The ₱50 monthly premium subscription is optional and requires manual payment
You assume all risks associated with using the platform and services
You will contact official emergency services directly in life-threatening situations
You are responsible for payments to service providers as agreed
